Samuel Barker
In the name of God Amen I Samuel Barker of Barlborough in the County of Darby
Gent being weak in Body but of a sound and Disposing Mind and memory and Calling
to mind the uncertainty of this Estate and the Certainty of a future Do make and
Ordain this my Last will and Testament in manner and form following Revoking and
making void all former wills heretofore made. First my mind and will is that all
my just debts and funeral expenses be paid and Discharged out of my whole and
personal Estate by my Executrix hereafter named.Item I give devise and bequeath
unto my niece Mary Bullus who Dwells with me and to her heirs and assigns
forever All my Messuages Houses Lands Tenements Rents and hereditaments at Edall
in the said County of Derby In Trust Nevertheless to and for the Uses Intents
and purposes hereafter mentioned ( That is to say ) That she the said Mary
Bullus and her Assigns shall and may take and receive the rents Issues and
profits of all the Same premisses to her and their Own proper Use and Uses for
and During the Term of the natural Life of the said Mary Bullus And Also That
she the said Mary Bullus Shall have full and absolute power and Authority in her
lifetime to Give Devise Settle Estate and Assure the reversion and Inheritance
of my said Lands Tenements Rents and hereditaments at Edall aforesaid Either by
her Last will and Testament or by any Other Writing to be by her Duly Executed
in the presence of three or more Credible Witnesses To and upon my Grandson
Samuel Boulsbey and his heirs or to and upon any one or more of my Grand
Children and his heir and their heirs as to her the said Mary Bullus Shall Seem
meet and Convenient and for want of Such Disposition as aforesaid Then I Give
and bequeath the said Lands and Tenements Rents and hereditaments at Edall
aforesaid from and Immediately after the decease of her the said Mary Bullus
unto the said Samuel Boulsbey his heirs and Assigns forever Item I Give Devise
and bequeath unto the said Mary Bullus and her Assigns for and During the Term
of her natural Life All that the New Erected Messuage Cottage or Tenament
Situate and being in Attercliffe in the County of York now in the possession of
me the said Samuel Barker Together with all the Outhouses and buildings
thereunto belonging And Also all that my little Croft in Attercliffe aforesaid
now in the possession of me the said Samuel Barker commonly Called or known by
the name of Three Sands Containing by Estimation half an Acre or thereabouts (be
the Same more or Less) and from and immediately after the Death of her the said
Mary Bullus, Then I Give Devise and bequeath all the said Messuage Cottage or
Tenement with the Close and premisses in Attercliffe aforesaid to my said
Grandson Samuel Boulsbey and his heirs forever In Case he the said Samuel
Boulsby Shall happen to Survive her the said Mary Bullus But if he the said
Samuel Boulsby Should happen to Die Living the said Mary Bullus Then my mind and
Will is that the said Mary Bullus Shall by her Last will & Testament or any
Other writing to be by her Duly Executed in the presence of three or more
Credible Witnesses Settle Estate and Assure and I Do hereby give her the said
Mary Bullus full and absolute power and Authority to Settle Estate & Assure all
the aforesaid Messuage Cottage or Tenement Close and premisses at Attercliffe
aforesaid from and immediately after her Decease To and upon any One or more of
said Grand Children and to his her and their heirs, as to her the said Mary
Bullus Shall Seem most reasonable and Convenient And I do Desire my Niece Mary
Bullus that She will Settle Estate and Assure that piece or parcel of Land at
Attercliffe aforesaid which was Lately purchased by me and her of One John
Stanniforth of Attercliffe aforesaid to and for Such uses as she Shall Settle
and Estate the other housing Lands and premisses in Attercliffe aforesaid and
for want of Such Gift Disposition or Settlement as aforesaid then I Give and
bequeath the reversion of all the Last mentioned premisses after the Death of
the said Mary Bullus to the right heirs of the said Samuel Boulsby forever Item
I Give Devise and bequeath unto my said Niece Mary Bullus the Sum of fourteen
hundred pounds to and for her Own proper Use Item I Give Devise and bequeath
unto my Grandson Samuel Boulby One half of all my Lands in West New Jersey of
which I have in the whole three quarters of a Propriety for and During the Term
of his natural Life and from and Immediately after the Decease of the said
Samuel Boulsby my Grandson then to the use and ______ of the first Son by the
said Samuel Boulsby Lawfully to be begotten and the heirs of the Body of Such
first Son and for Default of Such Issue to the use of the Second Son of said
Samuel Boulsby lawfully to be begotten and the heirs of the Body of Such Second
Son and for Default of Such Issue to the use of the third fourth Fifth Sixth
Seventh Eighth ninth and Tenth and every Other the Sons of the body of the said
Samuel Boulsby Successively as they Shall happen to be in Order and priority of
Birth and Seniority of Age and the heirs of their Several and Respective bodys
the Eldest of the Sons and the heirs of his Body being always preferred before
the Younger and the heirs of their bodies and for Default of Such Issue to the
use of all and every of his Daughter and Daughters of the said Samuel Boulsby --
Lawfully to be begotten and the Several heirs of their Several Bodies and for
Default of Such Issue to the use and behoof of my said Niece Mary Bullus her
heirs and assigns forever In trust Nevertheless that She the said Mary Bullus
her heirs or Assigns Shall Settle and Estate the Same to and amongst Such of my
Grand Children or to Such other of my Relations as to her Shall Seem most meet
and Convenient Item I Give, Devise and Bequeath unto my said Niece Mary Bullus
her heirs and assigns forever Two thousand Acres of the best of my Lands and
Tenaments in New Jersey Such as She or any One by her order or Appointment Shall
Elect Chose or pitch upon for her Use and as for the remaining part of my Lands
and Tenaments before mentioned to be Lying and being in West New Jersey and yet
undisposed of I Give Devise and bequeath the Same as followeth -- First I Give
and Devise thereout to Such of my Grandsons Boulbies and their heirs forever as
shall be willing to Go and Reside in West New Jersey aforesaid when they Shall
attain their Ages of One and Twenty Years respectively or are loose from their
Apprentiship Two hundred acres of land apiece and to Such of my Grand Daughter
Boulbies and their heirs forever as Shall be willing when they attain their Ages
of Twenty One Years to go and Reside in West New Jersey as aforesaid One Hundred
acres of Land apiece the Same to be Set out by my said Grandson Samuel Boulby if
he be then living But in Case he is then Deceased the Same to be Set out by my
said Niece Mary Bullus or by Such Other Person or persons as she Shall pitch on
or Appoint to Set forth the Same Item I Give and bequeath unto the first Issue
male of my Grand Daughter Elisabeth Boden and to his heirs forever Two hundred
acres of my Land in West New Jersey aforesaid to Enter to the same when he shall
Come to his Age of One and Twenty Years in Case he be brought up in the
Protestant Religion and not Otherwise But my mind and will is that if he be
Brought up in the Roman Catholic Religion that then I Give and bequeath the Same
to Such Other Son or Sons of my said Grand Daughter Boden as Shall be Brought up
in the Protestant religion and to their heirs forever But in Case none of her
said Sons be brought up in the protestant religion Then I Give and Bequeath the
same to and for the use and behoof of the said Samuel Bowlsby his heirs and
assigns forever in Case he be then Living and not Otherwise But if he be then
Dead I Give and Bequeath the Same unto my Neice Mary Bullus her heirs and
Assigns forever the Same to be by her Disposed of to my said Grand Children or
to Some Other of my Relations as to her Shall Seem most meet and Convenient And
my mind and will also further is that the said Samuel Boulsby or his assigns
Shall and will for and During his natural Life take and receive the rents Issues
and profitts of all my said Lands in West New Jersey to his Own proper Use until
Such Time as my said Grand Children Shall go to West New Jersey to make their
abode there But in Case my said Grandson Samuel Boulsby Shall happen to Dye
living my said Neice Mary Bullus That then my said Neice Mary Bullus her heirs
or Assigns Shall take and receive the rents Issues and profits of all my said
Land or Tenements in West New Jersey aforesaid unto her and their Own proper Use
until Such time as my said Grand Children Shall go to West New Jersey to make
their abode there And all the residue of my said Lands in West New Jersey
Aforesaid I do hereby give and Bequeath unto the said Samuel Boulsby his heirs
and Assigns forever in Case he be alive at my Decease But in Case he be then
Deceased I Give and bequeath the Same unto my Niece Mary Bullus her heirs and
Assigns forever In Trust Nevertheless that She the said Mary Bullus her heirs or
Assigns Shall Settle and Estate the same to and for the Use of such of my Grand
Children or any Other of my Relations as to her Shall Seem most Meet and
Convenient Item I Give and bequeath unto my said Niece Mary Bullus her heirs and
Assigns forever All my Lands Tenements Rents and Hereditaments in Pennsylvania
Containing five hundred Acres be the Same more or less And Wheras there will
become Due to me upon a Certain Indenture of Mortgage now in my Custody from Sir
John Roads Knight to my Executrix within three months next after my Decease the
Sum of Twelve hundred pounds Now I do hereby give Devise and bequeath the Same
in manner and form following (that is to Say) I give Devise & bequeath unto my
Niece Mary Bullus the Sum of Seven hundred and forty pounds being, part or the
said Sum of Twelve hundred pounds Item I will that my said Niece Mary Bullus
Shall pay into the hand of my Grandson Samuel Boulsby the Sum of Two hundred
pounds being another part of the Said Sum of Twelve hundred pounds In Trust that
he the said Samuel Boulsby Shall pay unto his Mother Martha Boulby the Interest
and Increase of the said Sum of Two hundred pounds Yearly and every Year During
her natural Life, the Same to be paid to her Own proper hands not withstanding
her Coverture and that her Receipt Shall be a Discharge for the Same unto the
said Samuel Boulsby his heirs Executors or Assigns or to Such Other Person or
Persons who of right Ought to pay and Discharge the Same and that the Interest
and Increase So Designed her Shall not be Subject or liable to the Debts
Dispositions Assignments or Incumbrances of her said Husband My mind and will
further is that in Case the said Samuel Boulsby be alive or any Child or
Children of his body Lawfully begotten and at the death of his said Mother--that
then the said Sum of Two hundred pounds Shall be for the proper Use of Such
Child or Children as the said Samuel Boulsby Shall leave living at the time of
his decease to be Equally Divided amongst them if more than One And my mind and
will also further is That in Case my said grandson Samuel Boulsby Shall Die
without any Children as aforesaid living the said Martha his mother That then
the said Principal Sum of two hundred pounds Designed for the said Samuel
Boulsby Shall immediately be returned and paid by the heirs Executors or
administrators of the said Samuel Boulsby into the hands of the said Mary Bullus
To and for the proper Use and behoof of the said Mary Bullus her Executors
administrators and Assigns forever Upon Condition Nevertheless that She the said
Mary Bullus her Executors administrators and Assigns Shall pay and Discharge the
Interest and increase thereof to the proper hands of the said Martha Boulsby
During her Natural Life in Such manner and form as the Same was Designed to be
paid her by the said Samuel Boulsby Item I Give Devise and bequeath unto
Elisabeth Boden my Grand Daughter the Sum of thirty pounds the Same to be paid
her Out of the Said Sum of Twelve hundred pounds and to the three Daughters of
my Son in Law Thomas Bowlsby--the Sum of thirty pounds apiece, and my Grandson
Jordan Boulsby the Sum of Twenty pounds and to the Other four of my Grand Sons
Boulsbeys the Sum of thirty pounds apiece the said Several Sums or Legacies to
be paid them out of the said Sum of Twelve hundred pounds Item I Give and
bequeath unto my Executrix hereafter named all Such Debts and Sums of money as
are Due and Owing to me from my Son in Law Thomas Boulsby Together with all Such
Writings and Securities as I have for the Same Item I Give unto my Daughter
Martha Boulbey one Guinea in Gold to be paid unto her Own proper hand not
withstanding her Coverture And I Give unto Thomas Boulsby her Husband the Sum of
five Shillings and my mind and will is that what I have herein before Given unto
them the said Thomas Boulsby & Martha his wife Shall be in full of what they or
Either of them may or Can Claim out of my whole Estate Item I Give Devise and
Bequeath unto my Grandson Samuel Boulsby and the heirs of his Body Lawfully to
be begotten all my part of the Royalty or Liberty of Matlock in the said County
of Darby But for Default of Such Issue of the body of the said Samuel Boulsby
then I give Devise and bequeath the same unto my Niece Mary Bullus her heirs and
Assigns forever Also I Give and bequeath unto the said Samuel Boulsby One Bed
and Bedding thereunto belonging the Same to be Set out by my said Niece Mary
Bullus Also I Give and Bequeath unto my said Niece Mary Bullus all my Estate
Tennant Right and Title of in and unto all that Messuage Cottage or Tenament
Lying and being in Barlbrough aforesaid now in the possession of One Timothy
Maden Also I Give and bequeath unto My Daughter in Law Mary Barker four Guineas
Item I do hereby Give Devise and bequeath unto my said Niece Mary Bullus all my
goods Chattells and Debts Due unto me by Bond Bill Mortgage or Otherwise And All
Other my Estate whatsoever not herein or hereby given and Disposed of And Lastly
I do hereby nominate and Appoint the said Mary Bullus to be the Executrix of
this my Last will and Testament In Witness whereof I the said Samuel Barker the
Testator to this my Last will and Testament being written upon Seven Sheets of
paper have Set my hand and Seal this ninth Day of January in the Eleventh year
of the Reign of our Sovereign Lord George Now King of Great Britain Anno Dom
1724 Samuel Barker.
