Peter Winstanley
In the name of God Amen I Peter Winstanley of Billinge in
the parish of
Wigan and county of Lancaster naylor being but weak in body but of sound
mind memory and understanding do make and publish this to be my last will
and testament in manner following, that is to say, It is my will and mind
and I do order and direct that all my just debts, funeral expenses and the
charges of proving this my last will and testament be first paid and
discharged by and out of such sum or sums of money as I may be possessed of
at my death. Then I give and bequeath all the rest residue and remainder of
such sum or sums of money as may remain after the above payments are made
and discharged unto my son Henry Winstanley for his own proper use and
benefit. I also give and bequeath all my shop tools and instruments made
use of in the trade or mystery of nayling or making nails unto my said son
Henry Winstanley. And as to all the rest residue and remainder of my
personal estate it is my will and mind, and I do hereby direct and order
that it is equally divided between my said son Henry Winstanley and Ellen
Winstanley my daughter share and share alike. I then give and devise all
that messuage or dwelling house where I now live together with the smithy,
barn, shippon and all the outhousing of every sort thereunto belonging and
also all my gardens orchards fields and lands lying and being in Billinge
aforesaid unto my said son Henry Winstanley and his heirs forever on these
express conditions only. First that he my said son Henry Winstanley pays
or causes to be paid the sum of twenty pounds unto my daughter Ellen
Winstanley and suffers her to dwell in the apartment called the old parlour
so long as she keeps herself single and unmarried I then order and direct
that my said son Henry Winstanley shall pay to my son John Winstanley the
sum of ten pounds, to my son James Winstanley the sum of ten pounds, to my
son Peter Winstanley the sum of ten pounds, to my son William Winstanley
the sum of ten pounds and also to my son Isaac Winstanley the sum of ten
pounds within the space of two years after my decease or give to them
respectively such security for the payment of the said several sums as they
shall approve. But in case my said son Henry Winstanley should refuse to
comply with the above mentioned conditions and to make the payments hereby
ordered to be made within the time limited then and in such case I do
hereby empower my executors herein named to dispose of and sell the above
devised premises and out of the monies arising from such sale to pay unto
my said daughter Ellen Winstanley the sum of twenty pounds, and to my sons
John, James, Peter, William and Isaac Winstanley respectively the sum of
ten pounds each. The rest, residue and remainder of much monies arising
from such sale I order and direct to be given to my son Henry Winstanley
and his heirs forever. Lastly I do hereby revoke all other will or wills at
any time heretofore by me made and do publish and declare this to be my
last will and testament of which I do appoint the Revd Richard Prescott of
Upholland, clerk and Robt Chadwick of Billinge, Executors. In witness
thereof I have hereunto set my hand and seal this fourth day of December in
the year of our Lord one thousand seven hundred and seventy three.
