Matthew Fearon
The will of Matthew Fearon of Gilcrux in the County of Cumberland. He gives and bequeaths to his daughter Isabella Fearon all his messuages, lands and hereditaments situate at Gilcrux aforesaid as well freehold as what he held in customary tenure of Mary Dykes as Lady thereof and which has lately surrendered to her as a Trustee to enable him to dispose thereof by will. To hold to his said daughter and the heirs of her body lawfully issuing and if she died without issue then to Samuel Ritson of Gilcrux aforesaid his heirs and assigns forever. He also gives and bequeaths his freehold and customary messuages, lands, tenements and hereditaments and real estate situate at great Broughton, Little Broughton and Dovenby in the parishes of Bridekirk in the said County which lustory premises are also surrendered to a trustee to enable him to dispose thereof by will to his nephew John Dodgson of Shatton and his heirs. Upon trust to apply the rents, issues and profit thereofin and towards the maintenance and support of his son John Fearon who is at present visited with limacysous … to be able to take care of and provide for himself during the term of his natural life in case he shall continue in the same state and if the said rents, issues and profits shall at any time prove insufficient for the maintenance and support of the said John Fearon then this John Dodgson and his heirs are authorised and empowered by sale or of mortgage of this freehold and customary premises or any part therefof to raise such further sum of money annually as may from time to time be required for the maintenance and support of the said John Fearon. And if it please God that the said John Fearon should be restored to his compleat understanding and a perfect state of mind to enable him to make a satisfactory and competent disposal of his affairs Then upon trust to dispose, surrender, convey and afsure the said last monied trust premises to such person and persons and for such estates and in such manner and form as th…. John Fearon shall by any competent deed or will or other proper instrument, order direct or appoint and forward of such order direction or appointment then after the death of the said John Fearon to the use of his said daughter, Isabella and the heirs of her body and for want of such issue there to sell the said premises or so much thereof as shall there remain and convert the same into money and which shall be taken and considered as personal estate and not as land and in the first place to pay thereout the several as at the time of the death of the John Fearon shall be his next of kin and would entitled to his personal estate under the statute made for the distribution of intestate estates. He gives out of the said purchase money to John Dodgson the younger of Shatton the sum of four hundred pounds. And to John Sougham the younger of Blindcrake, the sum of four hundred pounds to be paid six months from the sale of the estates and to be considered as vested interest and transim..able to their respective representatives. He gives all his personal estate to his daughter and I appoint her sole executrix
The above is the will of me, Matthew Fearon and I publish the same as my will and declare and intend it to stand as my will in case I make no other. Witness my hand and seal the nineteenth day of November 1794
